Tennessee Voters Approve Three Constitutional Amendments

Measures addressing bail eligibility, statewide property taxes and crime victims’ rights receive strong voter support

Tennessee voters approved three amendments to the state constitution Tuesday, Nov. 3, bringing changes to the state’s bail system, prohibiting statewide property taxes and expanding protections for crime victims, according to the Nashville Banner.

With approximately 65% of ballots counted, Amendments 1 and 2 each had received 66% support, while Amendment 3 had secured 75% of the vote, the Banner reported.

    Amendment 1: Bail Reform

The first amendment expands judicial authority to deny bail to individuals accused of certain violent crimes. The proposal, which advanced through the Republican-led legislature in 2024 and 2025, gives judges additional discretion but does not require them to withhold bail.

According to the Nashville Banner, supporters, including House Speaker Cameron Sexton, argued that the measure would help prevent individuals accused of serious violent offenses from being released and potentially committing additional crimes.

Critics questioned whether expanding pretrial detention would improve public safety. The Banner reported that opponents cited declining violent crime rates in Tennessee and research suggesting that increased pretrial incarceration does not necessarily prevent future offenses.

Amendment 2: Statewide Property Tax Ban

The second amendment prohibits Tennessee from imposing a statewide property tax. Gov. Bill Lee and House Speaker Sexton were among the prominent supporters of the measure.

The Nashville Banner reported that advocates promoted the amendment as a safeguard against homeowners, farmers and businesses being subjected to property taxes by both state and local governments.

Opponents expressed concern that the constitutional restriction could limit the state’s financial options during future economic emergencies.

    Amendment 3: Crime Victims’ Rights

The third amendment, commonly known as Marsy’s Law, establishes additional constitutional protections for crime victims.

According to the Nashville Banner, similar legislation has been adopted in 14 other states, although two later repealed their versions. The Tennessee proposal received unanimous approval in the state House.

Despite broad legislative support, some lawmakers raised concerns about implementation costs and additional demands on the judicial system. The Banner reported that critics also questioned the necessity of the amendment because Tennessee’s constitution already provides certain protections for crime victims.

All three amendments originated in the Tennessee General Assembly before being presented to voters for final approval.
